Definitions

In these Terms and Conditions, the following definitions apply:

  • "Software" means the Flintnet network monitoring agent, Flutter web interface, and all associated configuration files, documentation, and scripts distributed as part of the Flintnet product.
  • "Licensor" means the developer and rights holder of Flintnet.
  • "Licensee" or "You" means the individual or organisation that has downloaded, installed, or is operating the Software.
  • "Deployment" means an installation of the Software running on infrastructure owned or controlled by the Licensee.
  • "Network" means the computer network infrastructure owned or operated by the Licensee on which the Software is deployed and authorised to monitor.
  • "Data" means any network traffic, flow records, device information, metrics, alerts, or logs generated or collected by the Software.

Licence Grant

Subject to your compliance with these Terms, the Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to:

  • Download and install the Software on infrastructure you own or control.
  • Use the Software to monitor networks you own or for which you have explicit written authorisation from the network owner.
  • Make reasonable copies of the Software solely for backup and archival purposes.

This licence does not include the right to sublicence, sell, resell, distribute, or otherwise transfer the Software or any rights in it to any third party without prior written consent from the Licensor.

Permitted Use

The Software is licensed for use by network administrators, managed service providers (MSPs), and IT teams for the purpose of monitoring, managing, and securing their own or their clients' networks. Permitted uses include:

  • Monitoring network traffic flows, device inventory, and interface utilisation on authorised networks.
  • Detecting and alerting on security events including ARP spoofing, rogue devices, and traffic anomalies.
  • Generating reports and visualisations of network activity for internal operational purposes.
  • Deploying the Software on behalf of clients as part of a managed service, provided each client deployment is separately licensed.

Restrictions

You may not, and may not permit others to:

  • Use the Software to monitor any network or device without the explicit authorisation of the network owner.
  • Use the Software for any unlawful purpose, including unauthorised interception of network communications.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any compiled component of the Software, except to the extent permitted by applicable law.
  • Remove, alter, or obscure any proprietary notices, labels, or marks from the Software.
  • Use the Software to conduct attacks, intrusion attempts, or any form of offensive security operation against any network or system.
  • Redistribute, resell, or sub-licence the Software or any component of it without prior written consent from the Licensor.
  • Use the Software in any manner that could damage, disable, overburden, or impair the networks or systems being monitored.

Self-Hosted Deployment

Flintnet is designed exclusively as a self-hosted product. All Data collected and processed by the Software remains on infrastructure owned or controlled by the Licensee. The Licensor does not have access to, and does not collect, any Data from your Deployment.

Your network data never leaves your infrastructure. Flintnet does not include any telemetry, analytics, or data collection mechanisms that transmit information to the Licensor or any third party.

The Licensee is solely responsible for:

  • The security and integrity of the server infrastructure on which the Software is deployed.
  • Maintaining appropriate access controls to the Flintnet web interface and REST API.
  • Securing the API token and any credentials configured in the Software.
  • Ensuring the Software is kept up to date with releases provided by the Licensor.
  • Complying with all applicable laws regarding network monitoring and data retention in their jurisdiction.

Network Monitoring & Legal Compliance

Network monitoring software carries significant legal responsibilities. By using Flintnet you represent and warrant that:

  • You are the owner of the network being monitored, or have obtained explicit written authorisation from the network owner prior to deploying the Software.
  • Your use of the Software complies with all applicable local, national, and international laws governing network monitoring, data interception, and privacy.
  • Where the network carries traffic belonging to third parties (such as employees or customers), you have satisfied all applicable legal requirements including notification obligations.
  • You will not use packet capture data or flow records for any purpose other than the lawful administration and security of the monitored network.
Warning: Unauthorised network monitoring may constitute a criminal offence in many jurisdictions. The Licensor accepts no liability for any unlawful use of the Software. You are solely responsible for ensuring your deployment is lawful.

Data & Privacy

As a self-hosted product, Flintnet processes all Data locally on your infrastructure. The Licensor does not process any personal data on your behalf.

Network traffic data captured by Flintnet may constitute personal data under applicable privacy regulations (including GDPR and POPIA) if it can be linked to identifiable individuals. As the operator of a Flintnet deployment, you are the data controller for any such data and are responsible for:

  • Establishing and maintaining a lawful basis for processing network traffic data.
  • Implementing appropriate data retention policies and configuring InfluxDB accordingly.
  • Responding to data subject requests in accordance with applicable law.
  • Ensuring appropriate technical and organisational security measures are in place.

Security Responsibilities

The Software requires elevated network privileges (including raw packet capture capabilities) to operate. You acknowledge that:

  • The Software must be deployed on a dedicated, hardened host with appropriate access controls.
  • The API token configured via FLINTNET_API_TOKEN must be kept confidential and rotated regularly.
  • The Flintnet web interface should not be exposed to untrusted networks without appropriate access controls such as a VPN or reverse proxy with authentication.
  • SMTP credentials configured for email alerting must be stored securely and not shared.
  • You are responsible for monitoring security advisories from the Licensor and applying updates promptly.

Disclaimer of Warranties

The Software is provided "as is" and "as available" without warranty of any kind.

To the maximum extent permitted by applicable law, the Licensor expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Any warranty that the Software will be uninterrupted, error-free, or free of harmful components.
  • Any warranty regarding the accuracy, completeness, or reliability of any alerts, detections, or reports generated by the Software.
  • Any warranty that the Software will detect all security threats or network anomalies on your network.

Flintnet is a monitoring and detection tool. It does not guarantee the detection of all security incidents and should not be relied upon as the sole security measure for any network.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Licensor be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, business, or goodwill.
  • Damages arising from a security breach, data loss, or network outage, whether or not the Software was involved.
  • Damages arising from your failure to maintain the security of your Deployment.
  • Damages arising from reliance on any alert, detection, or report generated by the Software.

The Licensor's total cumulative liability to you for all claims arising out of or relating to these Terms or the Software shall not exceed the amount paid by you for the Software in the twelve months preceding the claim.

Intellectual Property

The Software and all intellectual property rights therein, including but not limited to source code, object code, documentation, design, trademarks, and trade secrets, are and shall remain the exclusive property of the Licensor.

These Terms do not convey to you any ownership interest in the Software. The licence granted herein is a licence to use the Software only, subject to the terms set out in this document.

The name "Flintnet" and the Flintnet logo are trademarks of the Licensor and may not be used without prior written permission.

Termination

This licence is effective until terminated. It will terminate automatically and without notice if you fail to comply with any provision of these Terms.

Upon termination you must immediately cease all use of the Software and destroy all copies in your possession or control.

The Licensor reserves the right to terminate your licence at any time for any reason with reasonable notice. In the event of termination by the Licensor without cause, any prepaid licence fees for the unexpired licence period will be refunded on a pro-rata basis.

Sections 4, 7, 9, 10, 11, and 13 shall survive termination of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
